James R. Carroll — Partner at Skadden, Arps, Slate, Meagher & Flom

Mr. James R. Carroll is a Partner at Skadden, Arps, Slate, Meagher & Flom, L.L.P. Mr. Carroll has experience in consumer products, insurance and securities class action defense as well as a broad array of complex civil litigations. He is currently national coordinating counsel for a major New York-based life insurer and is defending a variety of purported class and individual actions in the life, disability and casualty insurance contexts. He recently defeated class certification motions in 'vanishing premium' cases in Massachusetts and Mississippi. Mr. Carroll is defending federal securities law class actions pending in several jurisdictions, including the defense of issuers in so-called 'laddering' cases in the Southern District of New York. In 1999, he successfully utilized the Private Securities Litigation Reform Act of 1995 to obtain a rare denial of a class certification motion in a purported 10b-5 securities fraud class action. In 2000, he argued the first Rule 23(f) class certification appeal accepted by the First Circuit. His current engagements also include representing a 'top five' professional golfer in a high profile endorsement dispute, defending a major English entertainment company in a real estate dispute and defending two formal SEC investigations. In addition, he is defending a civil rights enforcement action brought by the Department of Justice against a Massachusetts company. Mr. Carroll also litigates a variety of covenant-not-to-compete and 'employee raiding' cases on behalf of several Massachusetts high technology firms. Additionally, Mr. Carroll has experience trying cases to arbitration panels of the NASD and AAA.
