Executive Bio

Mr. Richard Marmaro is a Partner at Skadden, Arps, Slate, Meagher & Flom, L.L.P. since January 2006. He is the head of Skadden's West Coast SEC enforcement and white collar defense practice. For more than 20 years, he has successfully defended individuals and corporations in all phases of complex civil, criminal and regulatory matters, including those involving allegations of insider trading, accounting and disclosure irregularities, market manipulation, financial frauds, sexual harassment and wrongful termination. He also has conducted numerous internal corporate investigations for Fortune 500 companies, involving issues including insider trading allegations, tax violations and corporate opportunity issues. Mr. Marmaro is actively involved in representing significant figures in numerous current government investigations, concerning corporate fraud and accounting, as well as other irregularities, including the defense of the former CEO of Gateway Computers in an SEC enforcement action; the New York Attorney General's investigation of Merrill Lynch and Credit Suisse First Boston into IPO allocation practices; SEC and federal criminal investigations of a former senior executive of Critical Path; SEC and federal criminal investigations of former executives of Gemstar-TV Guide; SEC and federal criminal investigations of a former controller of Peregrine Systems; the SEC and other regulatory agencies' investigation of a Merrill Lynch executive involving allegations of securities fraud and failure to supervise in connection with alleged market timing activities; and numerous other SEC, Attorneys General, criminal and regulatory investigations. Mr. Marmaro has tried numerous cases in federal and state courts around the country, and he was co-lead counsel in the successful defense of the former CEO and chairman of Columbia Savings. Prior to entering private practice in 1984, Mr. Marmaro served as a law clerk to a federal judge in the Southern District of New York and as Assistant United States Attorney in the Central District of California, where he was an Assistant Chief of the Criminal Division. As a federal prosecutor, Mr. Marmaro conducted and supervised numerous grand jury investigations and successfully prosecuted many individuals and companies on business-related crimes, as well as successfully argued numerous appeals before the Ninth Circuit Court of Appeals. Mr. Marmaro has taught civil trial practice at Southwestern Law School and has been on the faculty of the Attorney General's Advocacy Institute at the U.S. Department of Justice, where he participated in training Assistant U.S. Attorneys from around the country. In addition, he has served as the president of the Los Angeles Chapter of the Federal Bar Association. He has served as the co-chairman of the Central District's Attorneys Delegation to the Ninth Circuit Judicial Conference and he currently serves as the co-chairman of the Trial Practice Committee of the ABA's Litigation Section. Mr. Marmaro has appeared on CNN and KNBC as an expert commentator on white collar criminal issues. He is quoted frequently in such publications as The New York Times, The Wall Street Journal, Los Angeles Times, Washington Post, USA Today and Fortune magazine on issues relating to white collar criminal defense and SEC enforcement. He is also a frequent speaker at Bar groups on trial techniques. In 2004, he was elected as a Fellow of the International Academy of Trial Lawyers. For the past three years, Mr. Marmaro has been recognized by the Daily Journal as one of the top 100 most influential attorneys in the State of California. The Daily Journal has also recognized Mr. Marmaro as one of the leading white collar and SEC enforcement defense attorneys in California. In addition, Mr. Marmaro is consistently recognized as a 'leading lawyer' by Chambers USA: America's Leading Lawyers for Business and is listed in The Best Lawyers in America. He completed his J.D.from the New York University School of Law 1975 (Executive Editor, Journal of International Law and Politics) and B.A., from the George Washington University in 1972 (magna cum laude, Phi Beta Kappa).
