    Why is selecting the correct category important?

    Correctly categorizing your products will help shoppers locate your product quickly. Category placement will be important as Chairish inventory continues to grow and we expand our search filters and navigation menu.

    Although you can select up to 3 categories, we suggest limiting your listing to one single most relevant Category tag.

    How do I select a category on the listing form?

    When you select the Category field, a list of all possible category options available on Chairish will appear. You can drill down to subcategories to select the most relevant categorization for your type of item. You can also simply start typing the word for the type of furniture or decor item that best applies to your item for sale. As you start typing, a list of Category tag options will appear. Select the most appropriate Category tag from the list.

    For example, if you are listing a coffee table, start typing "coffee" into the Category field. You will see a list of category options drop down. To apply the "Coffee Tables" category tag to your listing, simply click on that category from the list of options.

    Titles

    Why are titles important?

    Descriptive titles help shoppers find exactly whatthey'relooking for when they search specific keywords on Chairish or on Google. We encourage our sellers to follow our recommendations for writing titles to ensure listings are optimized for search.

    Title Structure

    Use the following formula to create a descriptive title for your item. If youdon'tknow the maker, date, or style, be as detailed as possible with the details you do know about your item.

    Art title structure is slightly different than decor and furniture titles. It is important to have the same title format for each listing in your account and to follow one of the formats below. If Artwork Title and Artist Name are unavailable, please describe the subject of the artwork.

    We recommend keeping your titles limited to 5-6 words. Any keywords not mentioned in the title can be added to the description instead, as all words included in listing descriptions are searchable.

    Referencing Quantity in Titles

    If the price of your listing includes a pair of items, add "A Pair" to the end of your title so that the quantity offered for the price is clear to the shopper.

    If the price of your listing includes a set of items, add "Set of X" to the end of your title so that the quantity offered for the price is clear to the shopper.

    Superfluous Adjectives

    Avoid words like Beautiful, Lovely, Gorgeous, Stunning, Amazing, etc. These words are not beneficial for search and detract from the detail of the product. However, descriptive adjectives such as Large, Small, & Color are great for titles.

    For visual consistency between listings on Chairish, we encourage you to keep punctuation in your title to a minimum. Pleasedon'tadd "/", "~", "*", "( )", "+", or periods at the end of titles. "&" and "-" are acceptable punctuation.

    Why are descriptions important?

    Photos help guide shoppers to your product, but descriptions provide the shopper with more detail about history, wear, and condition to build confidence in the shopper to purchase your item.

    What should my description include?

    As many details as possible! In the description, it is encouraged that you document all of the details of the product with a minimum of 2 full sentences. It is also helpful to format the description with correct grammar and punctuation so that the first impression of your item to the shopper is clear and professional.

    Although there is no strict format to follow when creating descriptions, it is important to know what should and shouldnt be included. All keywords in the description are searchable on our site and on search engines. Please add any searchable key terms you think are important for locating your listing via search within the body of the description paragraph(s).

    Why are dimensions important?

    Many shoppers are looking for products with specific dimensions to fit a space. If the purchased product has dimensions in person that differ from the listing, you may be at risk for a return. Having correct dimensions also helps shoppers refine searches when using our dimension advanced search filters.

    How should dimensions be entered?

    In the listing form, there is a section for dimensions with three fields for Width (side to side), Depth (front to back), and Height (bottom to top). All three dimensions are mandatory and should only be entered in inches. If your listing contains more than one product of a different size, enter the largest dimensions in the dimension field and all additional dimensions in the description.

    If your item can be disassembled for shipping, please enter Shipping Dimensions of the item disassembled or box size on Part 3: The Logistics section of the listing form.

    Depending on the category of the item you are listing, you will be prompted to enter any additional dimensions that are specific to each category (such as each section of a sectional, seat height, arm height, etc). Please enter additional dimensions in the listing form in order to reduce the amount of Q&A from a shopper before purchase.

    Why are tags important?

    Similar to Categories, the Brand, Color, Material and Style tags are essential for search purposes. These tags make your product distinct and searchable through advanced filter settings.

    Just start typing the word for the Brand, Color, Material, or Style that you'd like to tag. As you start typing, a list of options will appear. Select the most appropriate tag from the list.

    To complete the Brand, Artist, or Designer, Styled After section of your listing, as you begin typing in each of these fields, a drop down list will appear from which you can choose the appropriate name. If you don't know the name(s) for these fields, you can type in "Unknown" or check "Unknown" at the top right of this section of the listing. If you don't see the name(s) in our pull down menus, you will still be able to type the name in the fields.

    For best results, please be sure to add the brand or artist/designer to the title or description of your listing.

    Why are photos important?

    Great photography will draw a shopper into your listing when they are browsing or searching on Chairish. As a curated site, photography is of huge importance in maintaining visual consistency and giving our customers the confidence to make a purchase - even when theycan'tsee the product in person.

    Great quality photography also makes your product more likely to be featured in a featured curated collection.

    You can upload up to 12 photos of your item and we encourage you to upload as many photos as possible. Width or height of each photo must be at least 460 pixels.

    The condition section of the listing form will ask a series of questions in order to gather a thorough condition report of your item.   • In accordance with new tax laws, tax liability is now determined based on the delivery address. If your order is being delivered to a taxable state, then tax will be added to your order. If your order is being delivered to a non taxable state, or a state in which you have tax exempt status, then you will not be charged.

    Registering for Tax Exemption

    If your business or organization is tax-exempt, you can register your exemption certificate on the Buyer Tax Settings page. If you are exempt in multiple states, please upload a certificate for each state.

    From the Buyer Tax Settings page, you can also remove old certificates or update expired ones.

    Submitting State Specific Requirements for Exemption

    Certain states require an additional step to validate your tax exemption documents. If your tax status is currently Temporary, you have 30 days to submit your cover page before your exemption expires. To complete the process, please email copies of your state cover page (which can be downloaded from your buyer's tax setting page) and proof of tax exemption status to:

  • If you are selling the same item in more than one color, size, pattern, etc., you can now link them together with our Variants feature! This will help you showcase all the options you offer for your new and made-to-order products.

    Adding a variant to an existing listing is easy! From your My Listings page, click Create a variant from this listing.

    All of the information from the previous listing will be copied over, except for the photos and title. Variant groups must have the same category and period made, so youwon'tbe able to edit these fields.

    Variants must be created and linked while the listings are still drafts. Once published, standalone listings cannot become variants; and once your variant listing has been published, it cannot be unlinked. If you have created a draft for a variant in error and want to "unlink" it from the variant group, click "Unlink this Draft" at the top of the product listing form.

    On collection pages, the oldest, or parent, listing will be featured as the primary image.

  • Parcel Delivery

    Smaller items and decor are generally shipped via UPS, FedEx or USPS and typically takes 10 days or less for delivery. Following a purchase ourcustomers will receive an email confirming the carrier name and tracking number. Most items shipwithin 3 business days following a sale.

    In-Home Delivery

    For larger items and furniture, our buyers and sellers will receive an update with the carrier name and tracking number via email, within 1 business day following a sale. This detail is also available within your Chairishdashboard under My Purchases or My Sold Items.

    Most larger items are picked up within an average of 15business days following receipt of a tracking number. Delivery typically occurs 3-6 weeks after pickup.

    Our Chairish In-Home Delivery shipping partners will handle any needed wrapping and/or packaging and all items are insured for the full sale price against any possible damage that may occur during the shipping process.

    Local Delivery (less than 50 miles): Local deliveries typically take 3 weeks or less.

    Longer Distance Delivery (greater than 50 miles): Deliveries generally take between 3-6 weeks. If the seller and/or buyer are located in smaller or more remote markets where pickup and delivery frequency is only once or twice per month,delivery may take up to 8 weeks.

    As a peer to peer marketplace selling unique pre-owned furniture going to and from sellers and buyers all over the country, shipping can take longer than traditional retail purchases. Most larger items require special handling and must be shipped using specialized shipping partners. If an item can be safely packed to move through lower cost small package (UPS/FedEx etc.) or freight channels, we do so.

  • Chairish offers two methods of payment to our sellers: PayPal and Stripe Direct Connect.

    Chairish processes payments for completed transactions, electronically, via PayPal or Stripe Direct Connect. As a Chairish Seller, you pay no additional fees - Chairish pays our payment partners a small transaction fee for each payment, which we absorb. If you are familiar with transfer limits - don't worry! Transfer limits on Chairish payments are higher than you may be accustomed to and this should never be an issue.

  • The second step of the listing form will ask you for specific item details. These fields will help tag data that we will use for advanced search filters. Well ask about the items age, condition, and dimensions, as well as some specific fields that relate to search.

    As you are filling out Step 2: The Details, you will receive error messages as you go if you have left any required fields empty. Once you have completed The Details, click the Next button to continue onto Step 3 of the listing form. If you would like to save your listing as a draft to finish later, click the Save button in the top right of the listing form page.

    To complete the Brand, Artist, or Designer section of your listing, as you begin typing in each of these fields, a drop down list will appear from which you can choose the appropriate name. If you don't know the name(s) for these fields, you can type in "Unknown" or check "Unknown" at the top right of this section of the listing. If you don't see the name(s) in our pull down menus, you will still be able to type the name in the fields.

    The Styled After field should be used if you cannot authenticate your item. If your item is believed to be designed by, attributed to, or in the style of, please enter that brand or designer name in the Styled After field, but keep the remaining Brand, Artist and Designer fields blank.

    For best results, please be sure to add the brand or artist/designer to the title or description of your listing.

    Styles

    When you click into the Style field, a list of all possible style options available will appear. Select up to three styles to describe your item for sale. Select from list or start typing a style to select a tag. For best advanced search results, tag a few styles that describe your individual item, rather than the style of room that the item could be placed in.

    Materials

    When you click into the Materials field, a list of all possible material options available will appear. When adding Styles, Colors, Materials, Rooms, you will just need to start typing and select the appropriate option from the drop down menu that appears. If you see a "+" next to names appearing in the drop down menu this indicates there are sub categories within those fields that you can select for a more defined description.

    For example, for the color "Gold" clicking on the "+" provides two additional options of brass and bronze.

    If you included a material keyword in the title or description, the listing form will suggest adding that material. You can select the material to apply the tag to the listing, or delete the material and add a tag better suited for your item.

    Colors

    When you click into the Colors field, a list of all possible color options available will appear. You can drill down to subcategories to select the most relevant option for your type of item.

    If you wrote a color keyword in the title or description, the listing form will suggest adding that color. You can select the color to apply the tag to the listing, or delete the color and add a tag better suited for your item.

    Rooms

    Room tag selection will help shoppers search and find your item when shopping by room. Select a room or two to categorize your item. For example, Beds and Headboards should be tagged with a Bedroom room tag, while Dining Tables could be tagged as Dining Room and Kitchen.

    Place of Origin

    Select the country where the item was made from the list in the dropdown menu.

    SKU

    Enter your item SKU (stock keeping unit) if applicable.

    Dimensions

    Many shoppers are looking for products with specific dimensions to fit a space. If the purchased product has dimensions in person that differ from the listing, you may be at risk for a return. Having correct dimensions also helps shoppers refine searches when using our dimension advanced search filters.

    In the listing form, there is a section for dimensions with three fields for Width (side to side), Depth (front to back), and Height (bottom to top). All three dimensions are mandatory and should only be entered in inches. If your listing contains more than one product of a different size, enter the largest dimensions in the dimension field and all additional dimensions in the description.

    If your item can be disassembled for shipping, please enter Shipping Dimensions of the item disassembled or box size on Part 3: The Logistics section of the listing form.

    Depending on the category of the item you are listing, you will be prompted to enter any additional dimensions that are specific to each category (such as each section of a sectional, seat height, arm height, etc). Please enter additional dimensions in the listing form in order to reduce the amount of Q&A from a shopper before purchase.

    Condition

    The condition section of the listing form will ask a series of questions in order to gather a thorough condition report of your item. Please add any additional comments about the condition in the Condition Details paragraph field. It is important to accurately describe the condition of your item to the best of your ability in order to reduce the amount of Q&A from a shopper and reduce the risk of a return after a sale.

  • Returns for Chairish In-Home, Chairish Local Delivery and Parcel Shipping items:

    For Chairish In-Home, Chairish Local Delivery, and Parcel shipping orders, buyers have 48 hours after delivery to inspect their item(s) and contact [email protected] if they wish to return an item. The buyer responsible for the outbound and return shipping charges, and they will be deducted from the buyer's original purchase price + taxes if applicable.

    For Parcel returns, buyers are responsible for packaging and shipping the return within three business days after the return shipping label (pre-paid by Chairish) is received. The buyer may also be responsible for the packing charges incurred by the seller. Buyers may not be reimbursed for returns that are not received in original condition.

    To make sure both the Buyer and the Seller are satisfied, Chairish collects payment from the Buyer at the time of purchase and only releases payment to the Seller after the 48-hour Return Policy window has expired.

    When contacting us to initiate a return, please include:

    Returns for Local Pickup or Seller Managed Local Delivery items:

    For Local Pickup and Local Delivery orders, all sales are final once the buyer, buyer's agent or buyer's shipper takes possession of item. The 48-hour return policy does not apply. If you decide to cancel the order at pick up, you, your agent or your shipper must reject the item at the time of pickup or delivery from the seller.     By purchasing, accepting or using the Chairish Gift Card ("Gift Card") and in consideration for your right to use the Gift Card, you agree to be bound by these terms and conditions (the "Gift Card Terms & Conditions") and the terms and conditions contained in the Chairish Terms of Service (the "Terms of Service"). In these Gift Card Terms & Conditions, "you" or "your" means either the cardholder who has purchased a Gift Card or the recipient of a Gift Card (as applicable). "We" or "our" means Chairish Inc.

    Chairish respects your privacy and will only use your personal information as described in our Privacy Policy.

    Purchase

    Gift Cards are electronic and may be purchased at https://www.chairish.com/pages/gift-card. In order to purchase the Gift Card, you will need to have or open a Chairish account. For purposes of delivering the Gift Card only, you will need to provide the name and email address of the recipient.

    Redemption

    The Gift Card may only be used to make Add to Cart purchases online at www.chairish.com ; due to the nature of how offers work, Gift Cards may not be used for payment towards offers at this time. Invalid or unidentifiable Gift Card numbers will not be redeemed.

    To redeem the Gift Card, you will need to have an existing Chairish account or create a new one. The Gift Card is not a credit card, charge card, or bank debit card and can only be used for the amount of funds loaded onto the Gift Card. The funds loaded on the Gift Card are collected by Chairish and deposited with and held by us in a pooled account with funds associated with other Gift Cards. You will not be paid or earn interest on the amount of the Gift Card. When making a purchase with the Gift Card, the value of the purchase plus any shipping/handling fees and sales tax, if applicable, will be automatically deducted from your Gift Card balance.     Expiration

    The funds on the Gift Card do not expire. No fees apply.

    However, in certain states, after a certain period of time, Chairish may remit the cash associated with unused Gift Card balances to certain states pursuant to their abandoned property laws. Once the Gift Card balance has been remitted to such a state, the Gift Card may no longer be redeemed, and Chairish may direct you to the state government instead.

    Restrictions

    Gift Card users must be 18 years or older.

    The prepaid value of the Gift Card cannot exceed $1,999.

    The Gift Card may be used to make Add to Cart purchases only up to the available balance on the Gift Card. If a purchase exceeds the amount of the Gift Card balance, the remaining balance must be paid with an additional payment method accepted by Chairish.

    Gift Cards may not be used for payment toward offers at this time.

    Coupons, discounts, and other Gift Cards may not be used to buy Gift Cards.

    The Gift Card cannot be reloaded (i.e. you cannot add value/balance to your Gift Card after purchase).

    Upon first use, the funds on the Gift Card are redeemed as an account credit to the Chairish account associated with the Gift Card's first use and become non-transferable.

    The Gift Card is not refundable or redeemable for cash or credit, except to the extent required by law. If your balance is below $10, and you would like to know if you qualify for cash redemption, please contact us at [email protected] and we will verify whether you qualify for cash redemption under applicable law.

    There is a 24 hour waiting period between the purchase of a Gift Card and when that Gift Card can be redeemed or used toward a purchase.

    No more than a total of $1000 in Gift Card funds may be redeemed per day, and no more than a total of $1500 in Gift Card funds may be redeemed per calendar month. Further, you may only redeem a maximum of 8 Gift Cards per day.

    Risk of Loss

    Please safeguard your Gift Card and treat it like cash. Title and risk of loss for the Gift Card pass to the recipient immediately upon purchase. Chairish is not responsible if a Gift Card is lost, stolen, destroyed, or used without the recipients permission. Lost or stolen Gift Cards may only be replaced or credited if the Gift Card has never been used, and only with satisfactory proof of purchase, where required by law.

    Disclosure to Third Parties

    As described in Chairishs Privacy Policy, Chairish may provide the personal information we collect in connection with your use of the Gift Card to trusted third party service providers that Chairish has contracted with in order to complete a transaction or to verify the existence and conditions of the Gift Card.

    Reservation of Rights

    Chairish reserves the right to correct the Gift Card balance if we believe that a clerical, billing, or accounting error has occurred. Chairish also reserves the right to deactivate, cancel, or suspend any Gift Card if we suspect fraud, unlawful activity, or improper Gift Card use.

    Disclaimer of Warranties; Limitation of Liability

    Chairish reserves the right to make changes to these Gift Card Terms & Conditions at any time without notice to you. If Chairish makes a material modification to these Gift Card Terms & Conditions, it may provide notice by displaying a notice on the Chairish website, by sending an email to any address you may have used to register for a Chairish account, or through other mechanisms. Any amendment to the Gift Card Terms & Conditions will be effective when posted on www.chairish.com.

    General

    If any of these Gift Card Terms & Conditions are deemed invalid, void, or for any reason unenforceable, the parties agree that the court should endeavor to give effect to the parties intentions as reflected in the provision, and the unenforceable condition shall be deemed severable and shall not affect the validity and enforceability of any remaining terms. These Gift Card Terms & Conditions and the relationship between you and Chairish will be governed by the laws of the State of California without regard to its conflict of law provisions. You and Chairish agree to submit to the personal jurisdiction of the federal and state courts located in the State of California with respect to any legal proceedings that may arise in connection with these Gift Card Terms & Conditions.   • On Chairish, buyers can choose between purchasing an item outright (the Add to Cart purchase option) or bargaining with the seller by making a Verified Offer (the Make An Offer option). All offers are Verified Offers, meaning the total offer amount is collected from the buyer at the time the offer is made. The process is the same whether you are making an offer on 1 item or making an offer on a product where more than one is available. All offers on Chairish listings must be at least 50% of the listing price of a single item.

    To protect both buyers and sellers, Chairish collects payments from buyers at the time of offer or sale, and holds the proceeds until after confirmation that the item has been picked up or delivered safely to its new home.

    For sellers, one of two things will happen when an offer is made:

    If you've set a "reserve price", and the offer is equal to or greater than the reserve price, the offer will automatically be accepted and the sale is complete.

    If the offer is below the reserve price you will receive an email with 3 easy choices:

    Accept - Offer is accepted and the deal is done

    Counter - You will be asked to provide the amount that you are willing to accept

    ORIGINAL ART & PRINTS

    Chairish accepts a broad assortment of antique, vintage and contemporary artwork in many styles and mediums, but all reflect high quality materials and craftsmanship. The Chairish shopper loves bright, colorful statement pieces including abstracts, landscapes, and Pop Art. Traditional subject matter consistently performs, too, and we also want more examples of portraits, paintings of animals, and large scale or scenic works.

    Art and prints may be declined for:

    Newly made replicas of vintage designs

    Reproduction, mass produced or stock artwork

    Color palette, medium or surface quality

    Art, sculpture and figurines depicting:

    Clowns and dolls

    Erotic nudes and sexual subject matter

    Violent subject matter, firearms or weapons

    The Chairish Artist Collective features a select group of emerging practicing artists. The Chairish Print Shop features a small invitation only group of artists selected based on their proven track record of success on Chairish with their original work.     DECORATIVE ACCENTS AND ACCESSORIES

    Given the vast secondary market for vintage and antique decorative accessories, our curators prioritize accents that are visually interesting, bright and unique. Examples of trending styles include: obelisks, Italian hand-painted ceramics, tulipieres, animalia, and collectible fine tabletop or accents (such as Herend, Fornasetti, Tiffany, etc.)

    Decorative Accents & Accessories may be declined for:

    We may accept items from these categories if they are purely decorative and not functional as a form of transportation.

    Musical Instruments

    We may decline musical instruments unless they are purely decorative decor items. We may not accept pianos due to size and shipping complications.

    Books - We love vintage and newly made decorative books with beautiful covers, especially when the subject matter is art and design.

    We may decline books based on poor product photography, subject matter, uniqueness, or newly made books.

    Candles

    While we do accept candle holders and candelabras, we will decline mass produced wax votive or taper candles.

    Home Appliances

    Vintage electric appliances such as refrigerators, stoves, radios and fans may be declined unless they are purely decorative

    Mass-produced Collectibles

    Mass-produced figurines, statues and sculpture, such as Lladro, Precious Moments, Hummel, Remington, etc.

    Mannequins and dolls

    Political Memorabilia

    Some advertising memorabilia, such as Coca Cola, pub decor, street signs, etc.

    Mass-produced Tabletop and Housewares, such as Corningware, Pfaltzgraff, Tupperware, etc.

    We may accept some religious items if they are high quality antiques with provenance

    Native American Arts & Crafts

    In accordance with the Indian Arts and Crafts Act of 1990, wecan'taccept any art or craft product in a manner that falsely suggests it as a Native American produced product, or the product of a particular Native American Tribe or Native American arts and crafts organization.

    Newly Made Replicas Of Vintage Or Industrial Style Designs

    Subject matter that implies ethnic caricature or cultural insensitivity

    Tribal Artifacts

    Due to the risk of misrepresentation of newly made replicas and travel souvenirs, we only accept high quality items from vetted sellers who specialize in imports, such as African and Asian artifacts

    Architectural Salvage - Architectural salvage that stands alone as a decorative object will be considered, dependant on condition.

    Architectural salvage that involves professional installation or is too utilitarian may be declined.

    Bulk architectural salvage hardware such as doorknobs, drawer pulls, brackets and light bulbs may be declined

    FURNITURE

    Furniture is one of our best performing categories and we are always trying to grow our assortment. We prioritize high quality and unique pieces from a wide range of eras and styles, including: anything (plaster, tole, or faux bois; important pieces by iconic designers (e.g. Springer, Saarinen, Ligne Roset, B&B Italia, Mario Lopes Torres, Baughman); other vintage or antique items in good condition, ready for use. Game tables, desks, and seating are in high demand.

    Furniture may be declined for:

    Vintage and antique childrens high chairs, cribs, and beds

    Other Childrens furniture and decor may be accepted based on style and uniqueness.

    Mattresses & bedding

    We cannot accept used mattresses, sofa bed mattresses, convertible sofas, pet beds or used bedding due to Federal & State regulations.

    JEWELRY AND FASHION ACCESSORIES

    Chairish is currently offering a limited selection of jewelry and fashion accessories sourced from a handpicked group of dealers. We only accept jewelry and fashion items from pre-approved sellers. Please contact [email protected] if you would like to be considered.

    Other jewelry and fashion accessories may be accepted if items are intended for use as decorative items, such as framed scarves or strings of beads.

    LIGHTING

    We are primarily focused on unique, colorful vintage and antique lighting in good condition. Lighting in unusual materials----such as tole, plaster, or faux finishes----also does well.

    Lighting may be declined for:

    Mass produced fixtures will be declined based on manufacturer and style

    Unbranded and mass produced art nouveau, arts & crafts and Victorian style lamps do not perform well on Chairish, so may be declined due to style

    Lighting fixtures that are in need of repair or have exposed wiring will be declined for safety concerns

    We do not accept lighting with a Blackamoor motif

    RUGS

    Vintage & Antique Rugs

    We are primarily focused on antique and vintage hand-made rugs including unique Turkish, geometric Kurdish, and Gabbeh styles. Were also seeing more interest in bright khotans, dhurries, Swedish rag rugs and Chinese art deco rugs. While neutral oushaks will always have a place on our site, our customers appreciate unusual colorways (especially blue, yellow, or pink) or unexpected pictorial designs.

    Traditional style rugs with borders and medallions typically don't perform well on Chairish. Vintage or antique rugs may be declined for:

    EMBARGOED AND ENDANGERED MATERIALS- US Government Regulations govern the sale of animal and wildlife products. Please refer to the US Fish & Wildlife Bureau Service website for the most up-to-date regulation. Due to the complexity of regulations that may differ state by state, we will now decline items made of the materials below:

    OVERSIZED/HEAVY ITEMS - Chairish is unable to manage shipping for items that we determine to be either oversized or extremely heavy. We may also decline certain items based on fragile or heavy material composition that could complicate shipping.

    Our fulfillment team will assess these listings to determine whether we can support shipping.

    Items may be accepted if the seller is able to offer seller managed shipping and can provide reasonable proof of an accurate shipping cost. Shipping cost cannot be increased once the item sells, though you are always welcome to reduce the cost of shipping.

    CONDITION

    We will not accept pieces that are excessively worn or are in need of major repair. An accurate description that describes the condition issues, a realistic condition report and detailed images will help us to determine fit, and increase your odds of a successful sale (with no complaints or returns).

    Items in Poor Condition

    While some patina is desirable, some items will be declined if they are not usable in their current condition

    Dirty or heavily stained textile or upholstered items (such as rugs, fabrics or drapes) should be professionally cleaned before listing on Chairish

  • A Marketplace Facilitator provides a platform for third parties to sell their merchandise.

    Chairish is responsible for calculating and collecting sales tax on all taxable orders (the buyer is located in a taxable state) and remitting the taxes to the appropriate party based on your Seller Tax Settings.

    Tax liability is assessed based on the buyers location. When the buyer is located in a taxable state, Chairish will calculate and collect the applicable tax upon check out.

    Based on your location and Seller Tax Settings Chairish will remit the sales tax in one of two ways:

    Marketplace Facilitator States

    When a buyer located in a Marketplace Facilitator State (37 states have already adopted this approach) purchases an item from you, Chairish will calculate, collect and remit sales tax to the state. No action is needed on your part!

    Nexus States

    A Nexus State is a state where you, the seller, have either a physical presence or have significant sales (speak with your tax advisor if you are unsure) - this is called economic nexus.

    When a buyer located in a Nexus State purchases from you, and you have physical or economic nexus in that state, Chairish will calculate and collect sales tax at checkout. The sales tax will be included in your seller payout when the order closes. It is your responsibility to remit sales tax to the state.

    How to determine if you have nexus?

    You are physically located in the state

    If you are unsure about your nexus status please check with your tax advisor.

    Your Tax Settings

    When logged into your Chairish account, update your Seller Tax Settings.

    The Chairish Drop Off & Go program makes packing your item(s) hassle and worry-free. For a small fee ranging from $5 - $33 depending on the size of the item,Chairish sellers can opt in to the Chairish Drop Off & Go program where a professional packing expert does all the work, making selling online easier than ever.

    Sellers using the Chairish Drop Off & Go service simply print out their Chairish shipping label that includes a prepaid packing code, and drop off their sold item(s) at the nearest The UPS Store franchise location. Chairish offers sellers a fixed packing cost, based on the size of the item. All items shipped as part of the program will also be insured against loss and damage with coverage provided to Chairish through UPS Capital Insurance Agency, Inc.*

    How Does It Work?

    Opt In: Select the Chairish Drop Off & Go option when creating or editing listings for eligible items. A flat fixed packing cost, ranging from $5-$33 per item based on size, will be displayed when you opt your listing into this program..

    Upon Sale: Sellers using the Chairish Drop Off & Go service simply print out their Chairish shipping label, which includes a prepaid packing code, and drop their sold item(s) off at their nearest The UPS Store franchise location. The UPS Store will take it from there.

    Upon Payment: The packing cost is deducted from your proceeds.

  • The third and final step of the listing form will ask about pricing and shipping preferences. You will also be able to specify if you are selling and pricing your listing as a set, or if you have more than 1 of the same item available to sell multiple times.

    As you are filling out Step 3: The Logistics, you will receive error messages as you go if you have left any required fields empty. Once you have completed The Logistics, click the Save & Submit button to send your listing to Chairish for curatorial review. Once a listing is accepted, it will be for sale on Chairish within 7 days. If we have questions regarding your listing, you may hear from us sooner.

    Some items may be better suited to sell as a set, such as Dining Sets and Chair & Ottoman Sets. Sets of items should be priced as a unit, rather than priced for individual pieces.

    If you would like to sell a set, please indicate that your asking price is for a set in the Inventory section of Step 3: The Logistics on the listing form. The listing form will ask Is this a set?, and upon answering Yes you will be prompted to add a count of the number of pieces included in the set. If you are selling a set of 8 dining chairs, you would enter Number of Pieces = 8. You will also be asked to specify how many times the set can be sold. E.g. Enter '1' for 8 chairs being sold as a single set. Enter '20' for 20 pillows being sold individually.

    If you can sell your listing multiple times (i.e., you have multiple items for sale that are the same), enter the quantity in the Number of times this can be sold field on the Inventory section of Step 3: The Logistics on the listing form. For guidance, hover over or click the ? mark for helpful tips. You will be emailed when the inventory count is low.

    The listing will simply remain available and show as for sale until the inventory count is sold out.

    The shopping cart functionality allows buyers to purchase more than one of an item, for items listed with multiple quantities available. For example, a buyer can purchase 5 purple silk pillows from a seller that has 20 purple silk pillows in a single order, instead of just 1 pillow at a time.

    Buyer are allowed to make offers on multiple quantities available. The verified offer will be presented to you as the seller as a subtotal offer price for all quantities selected.

    The value in the Number of times this can be sold field decreases as items are sold. You can update your available inventory simply by changing the value in that field. The value should represent your current available inventory - e.g. the remaining number of times your listing can be sold.

    Local Delivery Price

    Listing Flow Pricing Calculations: Payout is calculated in real time as you enter an Asking Price. Payout when Trade Discount and Reserve Price is applied is also calculated to illustrate Chairish commission after sale.

    Asking Price: You set the "asking price," but we may use our data, expertise, and knowledge of the market to suggest a price that will help you move your item more quickly. Whether or not you take our suggestion is up to you. Please note that the Chairish minimum listing price is $25.

    Trade Discount: Trade discounts go to verified Chairish users working in the interior design profession only. A typical trade discount is 15-30%.

    Reserve Price: The reserve price is the minimum you are willing to accept for each listing. Read more about setting a reserve price here.

    Estimated Retail Price: The estimated retail price is what you believe the item would sell for new.

    Shipping Dimensions

    In addition to standard/assembled dimensions, you are able to add shipping dimensions to more accurately estimate lower shipping rates. Will not apply to most vintage items, so there is an option to select to use the assembled dimensions previously entered.

    If your item cannot be disassembled, select the option to use the original dimensions as the shipping dimensions.

    Chairish In-Home and Chairish Local Delivery is always available for large items and can be indicated on the listing form by selecting Too Big to Fit in a Box. However, sellers may opt to include additional shipping methods such as local pickup or local delivery.

    If an item is being shipped through Chairish Parcel Delivery, sellers can opt the item into the Chairish Drop Off and Go program. Rather than packing an item themselves, sellers will then take the item to UPS to have it packed professionally. All items shipped as part of the program will also be insured against loss and damage with coverage provided to Chairish.

    Pickup Address

    The pickup address listed should be the physical location of the item if a shopper were to select local pickup. The pickup address is also important to accurately calculate shipping costs based on location of item and buyer.

    Pickup & Delivery

    Local pickup and local delivery allow reduced shipping costs to the buyer by receiving delivery from the seller in person.

    After purchase, the buyer must contact the seller within five business days of their purchase to coordinate a pickup or delivery date and time. We will share the buyer and seller contact information so that you can coordinate a convenient time for pickup. Failure to coordinate local pickup within five business days could result in a cancellation of the order. The seller must ensure the item is prepared and available for pickup at the agreed-upon location, date and time. You will receive a Verification Code to present seller at time of local pickup.

    We ask that the buyer inspect each item fully before completing a local pickup. All sales final once buyer takes possession of item.

    Many pieces listed on Chairish are designer, custom, antique, or high-end modern and vintage pieces from the likes of Knoll, Herman-Miller, Christian Liaigre, Ligne Roset, B&B Italia, etc. We also love non-branded items with great character.

    We currently accept furniture and decor. All items must have a minimum listing price of $25. Due to laws governing the sale of "used" or "secondhand" items, we are unable to accept mattresses, convertible sofas/sofa beds or recliners.

    Wedon'taccept everything for sale and we reserve the right to decline any item or request more information before listing. It may not be a reflection on the piece we may just have too much of a particular item or style.

  • You are responsible for the quality of your item and its listing, includingaccurate product information, photos and condition.You agree to accurately describe each item to the best of your ability. Chairish reserves the right to revise your listing for grammatical errors, photo editing, and other small corrections.

    You mustkeep inventory current (de-listing items no longer available); ship in a timely manner; mark shop in vacation mode when away for extended periods; respond to offers in a timely manner.

    You must ensure that the condition and quality of your item is suitable for resale. Please ensure that your item is clean and odor free, with the exception of any condition you have clearly disclosed in writing or per photographs in the listing description.

    Chairish reserves the rightto inspect or reject any item as unsuitable for sale at any time.

    If Chairish finds a buyer for your item and you circumvent or go around Chairish in an attempt to avoid payment of the Commission to Chairish, by selling to the buyer developed by Chairish directly, this will be treated as a sale and the Commission will be due and payable to Chairish.

    You covenant, represent and warrant that you have all rights, authority and clearances necessary for Chairish to sell the item on your behalf, and perform your rights and obligations under our Terms of Service.

    You will give Chairish or a buyer any documents necessary to transfer the ownership of the item to the buyer. You are solely responsible for all aspects of dealing with your clients and your business (e.g., paying or getting paid by your design clients, handling logistics between you and your clients, and managing your business), and handling all related inquiries and disputes.

    Welcome to Chairish, Inc. and its affiliated services, DECASO and Dering Hall, the online curated platforms for buyers and sellers of exceptional designs and antiques. Please read on to learn the rules and restrictions that govern your use of our Chairish, DECASO, and Dering Hall websites (including all data, contents and computer code contained on or transmitted from these websites), products, services and applications (collectively, the Services). These terms of service (the Terms of Service or TOS) are a binding contract between you and Chairish, Inc. and its affiliates, including DECASO and Dering Hall, (referred to throughout this TOS as Chairish, we, us, and our). This TOS includes the terms in this document, as well as those in the Privacy Policy and Copyright Dispute Policy. By using and accessing the Services, you have read, understood and agree to be bound by and comply with this TOS.

    For purposes of this TOS, "you" shall mean either you as an individual or the entity or person on whose behalf you are accepting this TOS. You represent that you are authorized to accept this TOS.

    Modifications to the Services

    We are constantly trying to improve the Services, so this TOS may need to change along with the Services. Accordingly, Chairish reserves the right to change or modify the Services (including any Memberships described below), any of the terms and conditions contained in this TOS and/or Membership Agreement, or any policy governing the Services at any time, including the commission or payment structure for any listing that has not expired.

    You are responsible for regularly reviewing any updates to this TOS at https://support.chairish.com/hc/en-us/articles/115007071507. If you do not agree with the new TOS, you are free to reject it; unfortunately, that means you will no longer be able to use the Services. If you use the Services in any way after a change to the TOS is effective, that means you agree to all of the changes. Except for changes by us as described here, no other amendment or modification of this TOS will be effective unless in writing and signed by both you and us.

    Use of the Services

    As a condition of using the Services you represent and warrant that you are at least sixteen (16) years of age. You may use the Services in one or both of the following capacities: (i) an individual, interior designer, architect, artisan, dealer or brand who wishes to list Goods for sale or to display portfolios of your work on Chairishs Services (collectively, "Sellers"), or (b) an individual who wishes to purchase Goods via the Services (collectively, "Buyers"). All users of the Services, including, without limitation, Buyers and Sellers are, collectively "Users").

    Chairish relies upon a community of independent Sellers that supply the Goods advertised on and sold through the Services. Chairish at no time holds possession of or title to the Goods advertised on and sold through the Services. Chairish is not a broker or your agent. Except for certain new, wholesale Goods sold directly by Chairish (the "Chairish Goods"), Chairish is not the Seller of any Goods listed on the Services. Chairish merely provides a marketplace for sales between Sellers and Buyers, and, except for Chairish Goods, is not involved in the transaction itself. Sellers may sell Goods through their storefronts on the Services and, except for Chairish Goods, such Goods are not owned or controlled by Chairish.

    Chairish reserves the right to cease offering the Services at any time.

    Account Set Up and Data

    In order to use the Services, you will be required to sign up for an account, select a password and user name and provide certain additional information about you to create your account ("Account Data"). You may not select as your user name a name that you do not have the right to use, or another persons name with the intent to impersonate that person. You may not transfer your account to anyone else without our prior written permission. You promise to provide us with accurate, complete and updated Account Data and to keep your Account Data accurate and current at all times.     You are responsible for the safekeeping of your password and account and are responsible for all activities, sales and purchases that occur under your password or account. You also agree that we will not be liable for any loss or damage arising from your failure to keep your password secure.

    We do not knowingly collect or solicit personally identifiable information from children under 16; if you are a child under 16, please do not attempt to register for the Services or send any personal information about yourself to us. If we learn we have collected personal information from a child under 16, we will delete that information as quickly as possible. If you believe that a child under 16 may have provided us personal information, please contact us at [email protected].

    For Buyers

    Certain of the Services may allow you to purchase Goods using the Services. If you purchase any Goods using the Service:

    You agree to pay the amount listed and any all other disclosed amounts, such as taxes, duties, costs and expenses. You agree that you are responsible for all payments and taxes associated with your use of the Services.

    You agree that we can automatically charge your credit card during the purchase process. All amounts are in US Dollars only.

    Certain of the Services may allow you to submit an offer for any Goods using the Services ("Verified Offer").     Certain transactions may display 'estimated value' on a listing but we are not evaluation experts and rely on data from sellers and publicly available data. Thus, we strongly recommend that you do your own research to determine the value of an item.

    While we do our best to give you accurate listing information, we cannot guarantee that the listing is 100% accurate and likewise cannot guarantee the authenticity of any item.

    Sellers are solely responsible for the accuracy in describing and pricing the Goods on the Service. Chairish relies on the Sellers for such information and is not responsible in any way for the description or pricing of Goods on the Services provided by the Seller. If you have any claims or disputes regarding any Seller or any Goods on the Service, please contact us at [email protected], and we will use reasonable efforts to facilitate the communication and resolution of such claims or disputes with the Seller. You agree and acknowledge that while Chairish may assist with resolving your claims or disputes regarding any Goods on the Services, (i) the ultimate resolution of any such claims or disputes is between you and the Seller, and (ii) Chairish is not responsible for successfully resolving any claims or disputes between you and the Seller..

    For Sellers

    You are responsible for collecting and paying any payments or taxes associated with using and making sales through our Services. Where applicable, we will issue 1099-K forms to certain sellers in the United States to comply with IRS requirements.

    Certain of the Services may allow you to list or otherwise offer Goods on the Services for sale. By listing or otherwise offering Goods on the Services for sale, you agree to the following:

    To ensure the integrity and quality of the Services, Chairish maintains certain policies and rules for its Services, including, without limitation, policies and rules to promote accurate representation and reliable delivery of Goods sold via the Services. You will comply at all times with all the policies and rules set forth in the applicable Seller FAQs: Chairishs Seller FAQ, DECASOs Seller FAQ. Chairish may update these policies and rules at any time, but if we do, we will bring it to your attention by placing a notice on the Chairish website, by sending you an email, and/or by some other means. If you use the Services in any way after a change to such policies or rules is effective, then you will be bound to comply with all such changes.

    . You represent and warrant that you own or have the right to sell the Goods, and that your Goods description, the Goods, and your conduct in listing the Goods comply with all applicable laws and regulations, as well as Chairish's policies.

    You will provide accurate and lawful descriptions and prices for each Good you list on the Services.

    You agree to complete the transaction promptly on the terms listed for the selected Goods.

    You may not list any Goods on the Services that:

    Violate any applicable law or regulation, or is an illegal item, including counterfeit or stolen items; or

    Infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party.

    If an issue or dispute arises between you and any Buyer regarding any Goods you offer on the Service for sale, please contact us at [email protected], and we will use reasonable efforts to facilitate the communication and resolution of such claims or disputes with the Buyer. You agree and acknowledge that while Chairish may assist with resolving your claims or disputes regarding any Goods on the Services, (i) the ultimate resolution of any such claims or disputes is between you and the Buyer, and (ii) Chairish is not responsible for successfully resolving any claims or disputes between you and the Buyer. In addition, Chairish reserves the right, for any reason, in our sole discretion and without notice to you, to remove any Goods you list, to suspend your access to the Services, or to otherwise impose consequences on you for behaviors that Chairish deems, in its sole discretion, to be inconsistent with Chairishs policies or the spirit of a trustworthy marketplace; Chairish will not be liable to you or to any third party for doing taking any such action.

    Certain Services may allow a User to communicate directly with you. When a User communicates with you to inquire about or purchase a product or otherwise, the User may provide you with certain personal information (including the User's name and email address and, in the case of a purchase, payment and shipping information). Without express consent, you shall not contact Users or use their personal information for any purpose other than Chairish-related communications and for completing the transaction for which the information was provided. You may not use this information to distribute unsolicited commercial messages. Certain Services may allow a User to follow you. Unless a User "follows" you, or the User consents, you may not add User to your email lists.

    Your Content on the Services

    Our Services include information, data, text, photographs, graphics, images, video, messages, tags, or other materials ("Content") from many people and entities, including you, and such Content is the sole responsibility of the person or entity that provided it. This means that you are entirely responsible for all Content that you email, transmit, upload or otherwise make available while using the Services (including through any third party service integrations you enable through the Services), and for the consequences of your actions (including any loss or damage which Chairish may suffer). Chairish does not claim ownership of such Content.

    When you upload or post any Content to our Services, you grant to Chairish and its affiliates a license and right to such Content (and any intellectual property or other proprietary rights you have in such Content) to distribute, syndicate, reproduce, modify, adapt, store, publish, publicly perform, publicly display, make derivative works of, and otherwise use, in the broadest sense permitted under applicable law, such Content on or off the Services: (a) for the purpose of providing the Services to you and other Users, such as promoting your listings on the Services; and (b) with respect to Content that is related to the Goods, such as information, photographs, and videos of your Goods, for the purpose of marketing and promoting the Services. For example, for marketing and other purposes, Chairish will occasionally display your Content or listings on other great sites, like Facebook, Twitter and Pinterest. You agree that the licenses you grant us with respect to such Content are royalty-free, perpetual, sublicenseable, irrevocable, and worldwide. In order to participate in certain additional Chairish programs or features, Chairish may need additional rights with respect to your Content in order to provide such Chairish programs or features to you. Any such additional rights, if necessary, will be specified in separate agreement between you and Chairish that you will have the right to review and approve. For example, if you participate in our program that enables interior designers to submit lifestyle imagery for inclusion in Chairishs designer directory or editorial features, Chairishs rights in such content will be set forth in a separate agreement.

    You represent and warrant that you own or otherwise control or have a license to all necessary rights to the Content that you post or submit to Chairish for use on the Services and that you have sufficient rights to grant this license to such Content to Chairish. In addition, you agree that Chairish and its respective affiliates, successors and assigns is not under any obligation of confidentiality with respect to any such Content and that by posting Content, other Users may re-post your Content on third party websites.

    Please Don't Abuse Others or Our Services

    You agree to not:

    fail to deliver payment for Goods purchased by you;

    fail to deliver Goods purchased from you;

    manipulate the price of any Good or interfere with other Users' listings;

    circumvent Chairishs policies;

    circumvent or manipulate our fee structure, the billing process, or fees owed to Chairish;

    engage in any unsolicited or unauthorized advertising, "spamming" or "chain letters," or any other form of solicitation;

    share Chairishs or other Users proprietary information or Content obtained through Chairishs Services outside of the Services without Chairishs or such Users written consent;

    abuse or harass another using the Services;

    interfere with or disrupt the Services or servers or networks connected to the Services; or

    intentionally or unintentionally violate any applicable local, state, national or international law;

    access the Services (a) by any means other than through the interface that is provided, or (b) through any automated means (including use of bots, scripts or web crawlers);

    override or circumvent any security components or violate any usage rules relating to the protection of materials or technology on the Services; or

    transmit or make available any harmful material.

    You agree to not upload, post, or transmit or make available any Content that:

    is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable; or

    infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party (including Chairish).

    From time to time, Chairish may modify the rules of its Services to promote accurate representation and reliable delivery of Goods sold on its Services. We have the right, but not the obligation, in our sole discretion to impose consequences on you for behaviors that Chairish deems, in its sole discretion, to be inconsistent with Chairishs policies or the spirit of a trustworthy marketplace. In addition, we have the right, but not the obligation, in our sole discretion to pre-screen, refuse, or remove any buyer, seller, listing, item or Content from the Services.

    Commission Fees

    Commissions: Certain of our Services may charge a commission if you elect to sell Goods on the Services. In such instances, Chairish will charge you a commission for each sale in accordance with its then-current commission rate and payment structure, available at https://support.chairish.com/hc/en-us/articles/115006460407-Chairish-Commission, and https://support.decaso.com/hc/en-us/categories/203940867. Chairish will deduct the amounts due for the commission from the amounts payable to Seller for each transaction conducted through the Services. Chairish reserves the right to change its commission rates at any time upon notice to you. Such changes shall be effective for all listings of Goods on the Services as of the date provided in Chairishs notice.

    Memberships and Membership Fees

    Memberships: Certain of the Services or features of the Services are made available by us solely to a limited number of Users who meet certain criteria established by Chairish and who pay applicable membership fees ("Members"). "Membership" in Chairish entitles a Member to access certain benefits. In order to become a Member, you must agree to a separate membership agreement (the "Membership Agreement") and pay the applicable membership fees (the "Membership Fees"). We may offer a number of different levels of Memberships. The benefits and features of each type of Membership and the related requirements and applicable fees are set forth in detail in the Membership Agreement. We reserve the right to modify, terminate, or otherwise amend the various Memberships offered by us, including the criteria for different levels of Memberships and the contents, benefits, and rights of the levels of Memberships.     Member Criteria: You acknowledge that all Members are selected by Chairish in its sole discretion, and Chairish has the right to refuse or reject a User's application for one or more Memberships for any reason, or for no reason at all. In addition to meeting the requirements for one or more Memberships (which are set forth at https://support.chairish.com/hc/en-us/categories/115001052668, https://support.decaso.com/hc/en-us/categories/203940867, and https://deringhall.com/start and incorporated in this TOS), in order to use the Services as a Member, you must have a current and signed Membership Agreement with Chairish, and you must pay all required Membership Fees and other payments in accordance with the terms herein and as otherwise set forth in your Membership Agreement.

    Billing and Payment Schedule: If you become a Member, you agree to pay all applicable Membership Fees for Membership set forth in your Membership Agreement, which shall be due on the 1st of each month or if the 1st falls on a weekend or bank holiday, the first business day thereafter. You may elect to receive additional fee-based services (e.g. dealer advertising) and buyer-related services (e.g. concierge service) and you agree to pay all fees for such services set forth in the Membership Agreement. You must provide current, complete and accurate credit card and billing information. We will charge the Membership Fees and any other fees for additional services you receive to the credit card on file when such fees become due. If we are unable to charge your card for such fees, you must provide an alternate payment method for such fees. You must promptly update all information to keep your billing account current, complete and accurate (such as a change in billing address, credit card number, or credit card expiration date). Chairish reserves the right to change the Membership Fees and any other fees for additional services at any time, provided that Chairish will notify Members in writing at least 30 business days before any contemplated fee change becomes effective.

    Membership Termination: You may terminate your Membership by notifying Chairish in writing with at least 30 (thirty) days' prior notice. Chairish will not provide any refunds for previously paid Membership Fees at time of cancellation. Chairish may revoke a Sellers Membership, in its sole discretion, without notice if a Member violates the terms of this TOS or any Membership Agreement, engages in fraudulent or unethical conduct, fails to pay applicable fees, or engages in practices resulting in customer service issues that negatively impact other Users of the Services.

    Interactions with Third Parties

    Any information or Content publicly posted or privately transmitted through the Services is the sole responsibility of the person from whom such information or Content originated You access all such information and Content at your own risk and wearen'tliable for any errors or omissions in that information or Content or for any damages or loss you might suffer in connection with it. For example, Sellers may upload, post or otherwise provide to Chairish for use on the Services certain text, materials, or images related to their Goods or in setting up their storefronts on the Services. You agree that Chairish is not responsible for any such information, text, graphics, images, photos, video, items of Goods, links or other content posted by Sellers with respect to the Goods or for the quality of Goods purchased from such Sellers. We cannot control and have no duty to take any action regarding how you may interpret and use the Content or what actions you may take as a result of having been exposed to the Content, and you hereby release us from all liability for you having acquired or not acquired Content through the Services. Wecan'tguarantee the identity of any users with whom you interact in using the Services and are not responsible for which users gain access to the Services.

    Certain of our Services may contain links or connections to third party websites or services that are not owned or controlled by Chairish. When you access third party websites or use third party services, you accept that there are risks in doing so, and that Chairish is not responsible for such risks. We encourage you to be aware when you leave the Services and to read the terms and conditions and privacy policy of each third party website or service that you visit or utilize.

    Chairish has no control over, and assumes no responsibility for, the content, accuracy, privacy policies, or practices of or opinions expressed in any third party websites or by any third party that you interact with through the Services. In addition, Chairish will not and cannot monitor, verify, censor or edit the content of any third party site or service. By using the Services, you release and hold us harmless from any and all liability arising from your use of any third party website or service.

    Your interactions with organizations and/or individuals found on or through the Services, including payment and delivery of goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such organizations and/or individuals. You should make whatever investigation you feel necessary or appropriate before proceeding with any online or offline transaction with any of these third parties. You agree that Chairish shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings.

    If there is a dispute between participants on this site, or between users and any third party, you agree that Chairish is under no obligation to become involved. In the event that you have a dispute with one or more other users, you release Chairish, its officers, employees, agents, and successors from claims, demands, and damages of every kind or nature, known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way related to such disputes and/or the Services. If you are a California resident, you shall and hereby do waive California Civil Code Section 1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which, if known by him or her must have materially affected his or her settlement with the debtor."

    Third Party Charges

    You are solely responsible for any fees or charges incurred to access the Services through an internet access or mobile access provider, or other third party.

    Proprietary Rights

    All right, title and interest to the Services (which includes any Chairish content or materials made available via the Service, the Services' look and feel, the designs, service marks, trademarks and trade names displayed on the Service) are the property of Chairish, its affiliates, licensors or users, and are protected by copyrights, patents, trademarks or other proprietary rights and laws.

    You may not use, copy, modify, create a derivative work from, reverse engineer, sell, assign, sublicense or otherwise transfer any right, of any part of the Services without the prior written consent of the respective owner.

    Unless otherwise agreed to in a separate agreement between us, with respect to any software or applications that we make available to you (collectively, the "Software"), Chairish grants you a personal, worldwide, royalty-free, non-assignable and non-exclusive license to use such Software provided, for the sole purpose of enabling you to use the Services in the manner permitted by this TOS. You may not (and you may not permit anyone else to) copy, modify, create a derivative work of, reverse engineer, decompile or otherwise attempt to extract the source code of the Software or any part thereof. You may not assign or grant a sublicense of your rights to use the Software, grant a security interest in or over your rights to use the Software, or otherwise transfer any part of your rights to use the Software.

    You agree to only use the Services for personal purposes, and not for any unintended use of the Services. You agree not to reproduce, duplicate, copy, sell, trade, resell, frame, or exploit for any commercial purposes, any portion of the Services.

    Feedback

    By submitting feedback, ideas, ratings, reviews, or suggestions ("Feedback") to Chairish, publicly through web pages (e.g. forums), or privately through customer service, you acknowledge and agree that: (a) your Feedback automatically becomes the property of Chairish without any obligation of Chairish to you; (b) your Feedback does not contain confidential or proprietary information of you or any third party; (c) Chairish may use or disclose such Feedback for any purpose, in any way, in any media worldwide; (d) Chairish may have something similar to the Feedback already under consideration or in development; and (e) you are not entitled to any compensation or reimbursement of any kind from Chairish.

    Indemnity

    You agree to indemnify and hold Chairish and its affiliates, members, officers, agents, employees, partners and licensors harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of the Goods you buy, sell, or offer to sell using the Services, your Content, your use of the Services, your violation of this TOS or any Membership Agreement, your violation of any applicable law, rule or regulation, or your violation of any rights of another.

    Termination

    You agree that Chairish may terminate your Chairish account and access to the Services at any time, without notice, for any reason, including but not be limited to, (a) breaches or violations of this TOS, including any policies or documents incorporated by reference, or any other agreement you have entered into with Chairish, (b) requests by law enforcement or other government agencies, (c) a request by you to delete your account, (d) discontinuance or material modification to the Services, (e) unexpected technical or security issues or problems, (f) extended periods of inactivity, (g) engagement by you in fraudulent or illegal activities, or (h) nonpayment of any fees owed by you in connection with the Services. Chairish may delete your Content, your password and all related information, and files and content associated with your account. You agree that Chairish shall not be liable to you or any third party for any termination of your account or access to the Service.

    DISCLAIMER OF WARRANTIES

    Your use of the Services is at your sole risk. Neither Chairish nor its licensors or suppliers makes any representations or warranties concerning any Content contained in or accessed through the Services, and we will not be responsible or liable for the accuracy, copyright compliance, legality, or decency of material contained in or accessed through the Services. We (and our licensors and suppliers) make no representations or warranties regarding suggestions or recommendations of services or products offered or purchased through the Services. Products and services purchased or offered (whether or not following such recommendations and suggestions) through the Services are provided AS IS and without any warranty of any kind from Chairish or others (unless, with respect to such others only, provided expressly and unambiguously in writing by a designated third party for a specific product). THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. CHAIRISH AND ITS AFFILIATES, MEMBERS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT; AND MAKE NO WARRANTY THAT (I) THE SERVICES WILL MEET YOUR REQUIREMENTS; OR (II) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

    Limitation of Liability

    TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY (INCLUDING, WITHOUT LIMITATION, TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE) SHALL CHAIRISH ITS AFFILIATES (OR ITS OR THEIR LICENSORS OR SUPPLIERS) BE LIABLE TO YOU OR TO ANY OTHER PERSON FOR (A) ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING DAMAGES FOR LOST PROFITS, LOSS OF GOODWILL, WORK STOPPAGE, ACCURACY OF RESULTS, COST OF REPLACEMENT OF SUBSTITUTE GOODS OR COMPUTER FAILURE OR MALFUNCTION, OR (B) ANY AMOUNT, IN THE AGGREGATE, IN EXCESS OF THE GREATER OF (I) $100, (II) THE AMOUNT DUE UNDER OUR THEN-CURRENT REFUND POLICY, OR (III) THE FAIR MARKET VALUE OR LISTING PRICE OF THE GOODS ITEM SUBJECT TO THE APPLICABLE CLAIM, OR (C) ANY MATTER BEYOND OUR REASONABLE CONTROL.     Arbitration

    All disputes under this TOS and/or any applicable Membership Agreement that cannot be resolved by the parties shall be submitted to arbitration under the Streamlined Arbitration Rules and Procedures of Judicial Arbitration and Mediation Services, Inc. ("JAMS") then in effect. Either party may invoke this paragraph after providing 30 days' written notice to the other party. All costs of arbitration shall be divided equally between the parties. Any award may be enforced by a court of law. Notwithstanding the foregoing obligation to arbitrate disputes, each party shall have the right to pursue injunctive or other equitable relief at any time, from any court of competent jurisdiction. Any arbitration under these Terms will take place on an individual basis: class arbitrations and class actions are not permitted. YOU UNDERSTAND AND AGREE THAT BY ENTERING INTO THESE TERMS, YOU AND COMPANY ARE EACH WAIVING THE RIGHT TO TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.

    General

    Any provisions hereunder that are intended to survive expiration or termination of this TOS will survive. The parties are independent contractors with respect to each other and no third party beneficiaries are created hereunder. Neither party is a partner, joint venturer, or agent of the other and shall not bind nor attempt to bind the other to any contract. We may provide you with notices, including those regarding changes to this TOS and/or a Membership Agreement, including but not limited to by email, regular mail, text message, postings on the Service, or other reasonable means. All notices you provide to us must be in writing and sent by registered mail, recognized carrier, or confirmed fax transmission, and will be deemed received upon receipt. Failure to insist upon strict performance or to exercise any term hereof will not act as a waiver of any right herein, and any waiver must be in a signed writing to be valid. You may not assign, delegate or transfer your rights or obligations hereunder, or your Services account, in any way (by operation of law or otherwise) without Chairishs prior written consent. We may transfer, assign, or delegate our rights and obligations under this TOS without consent. This TOS inures to the benefit of and shall be binding on any permitted assignees. This TOS and any applicable Membership Agreement constitutes the complete, final and exclusive agreement between the parties with respect to the subject matter hereof, and supersedes all other understandings or agreements concerning the subject matter hereof. Except for modifications or changes by us as described above, any amendment to this TOS must be in a signed writing. This TOS shall be governed by the laws of the State of California. The parties agree that the federal and state courts in San Francisco County, California will have exclusive jurisdiction and venue under this TOS. In the event that any provision of this TOS and/or Membership Agreement shall be determined to be illegal or unenforceable, that provision will be limited or eliminated to the minimum extent necessary so that this TOS and/or Membership Agreement shall otherwise remain in full force and effect and enforceable.

    Copyright Dispute Policy and Notice Procedure

    Chairish respects the intellectual property of others, and we ask our users to do the same. You may have heard of the Digital Millennium Copyright Act (the DMCA), as it relates to online service providers, like Chairish, being asked to remove material that allegedly violates someones copyright. We reserve the right to (1) block access to or remove material that we believe in good faith to be copyrighted material that has been illegally copied and distributed by any of our advertisers, affiliates, content providers, members or users and (2) remove and discontinue service to repeat offenders.

    Procedure for Reporting Copyright Infringements. If you believe that material or content residing on or accessible through the Services infringes your copyright (or the copyright of someone whom you are authorized to act on behalf of), please send a notice of copyright infringement containing the following information to the Chairishs Designated Agent to Receive Notification of Claimed Infringement (our Designated Agent, whose contact details are listed below):

    A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that has been allegedly infringed;

    Identification of works or materials being infringed;

    Identification of the material that is claimed to be infringing including information regarding the location of the infringing materials that the copyright owner seeks to have removed, with sufficient detail so that Chairish is capable of finding and verifying its existence;

    Contact information about the notifier including address, telephone number and, if available, email address;

    A statement that the notifier has a good faith belief that the material identified in (1)(c) is not authorized by the copyright owner, its agent, or the law; and

    A statement made under penalty of perjury that the information provided is accurate and the notifying party is authorized to make the complaint on behalf of the copyright owner.

    Once Proper Bona Fide Infringement Notification Is Received by the Designated Agent. Upon receipt of a proper notice of copyright infringement, we reserve the right to:

    remove or disable access to the infringing material;

    notify the content provider who is accused of infringement that we have removed or disabled access to the applicable material; and

    terminate such content provider's access to the Services if he or she is a repeat offender.

    Procedure to Supply a Counter-Notice to the Designated Agent. If the content provider believes that the material that was removed (or to which access was disabled) is not infringing, or the content provider believes that it has the right to post and use such material from the copyright owner, the copyright owner's agent, or, pursuant to the law, the content provider may send us a counter-notice containing the following information to the Designated Agent:

    A physical or electronic signature of the content provider;

    Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled;

    A statement that the content provider has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material; and

    Content provider's name, address, telephone number, and, if available, email address, and a statement that such person or entity consents to the jurisdiction of the Federal Court for the judicial district in which the content providers address is located, or, if the content provider's address is located outside the United States, for any judicial district in which Chairish is located, and that such person or entity will accept service of process from the person who provided notification of the alleged infringement.

    If a counter-notice is received by the Designated Agent, Chairish may, in its discretion, send a copy of the counter-notice to the original complaining party informing that person that Chairish may replace the removed material or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider accused of committing infringement, the removed material may be replaced or access to it restored in 10 to 14 business days or more after receipt of the counter-notice, at Chairishs discretion.

    In accordance with new tax laws, tax liability is now determined based on your location. If youre in a taxable state, then tax will be added to your order. If you are not in a taxable state, then you will not be charged.

    If your business or organization is tax-exempt, you can register your exemption certificate on the Buyer Tax Settings page. If you are exempt in multiple states, please upload a certificate for each state.

    Managing Exemption

    From the Buyer Tax Settings page, you can also remove old certificates or update expired ones.

  • Chairish is a marketplace connecting buyers and sellers directly, eliminating the middle-men and multiple mark-ups typically found in the industry. This means that Chairish list prices can be significantly lower for buyers and at the same time sellers still take home more money than is possible elsewhere.

    We encourage sellers to list their items at 25-30% of the Estimated Retail Price and we adjust up or down from there, based on age, condition and popularity of a particular style.

  • OFFERS and COUNTER OFFERS:

    The history of your offers can be viewed, once logged into your account, within the My Offers page.

    If you make a verified offer that is countered by the seller, the funds for your original offer will be released. Depending on your financial institution, the release may take up to 5 days to appear on your account.

    If you accept the seller's counter offer, your card will be charged for the seller's counter offer amount.

    If you decide to counter the seller's counter offer, a new hold will be placed on your card for the amount of your counter offer + fees and shipping.

    If you choose not to accept the seller's counter offer, please do not take action to Accept or Counter. The funds for your original offer will be released.

    If the seller doesnt accept the counter offer, the funds for your original offer will be released. We will also release funds if the offer expires after the 72 hour expiration window.

    The process is the same whether you are making an offer on 1 item or making an offer on a product where more than one is available.

    RE-ENGAGEMENT:

    If a seller declines your offer, they do have the option to reach out and retroactively accept your offer for up to 30 days.   • Prior to shipping, local pickup or local delivery, buyers may cancel an order for any reason. Please notify us within 24 hours of purchase if you would like to cancel an order, as prompt cancellation will reduce the likelihood that you will incur return shipping charges.

  • As a seller on Chairish, you can remove listings from your shop in two ways: deactivating, and deleting.

    Deactivating your listings can be done from the For Sale tab on the My Listings page. Once you have located the listing that you would like to deactivate, click the dropdown on the right hand side of that listing entry and select Deactivated to update the listing status. This will move the listing to your Inactive tab. The listingwon'tbe available for purchase, but you will be able to move it back!

    Deleting your listings is permanent; a listing that is fully deleted is fully removed from your Seller Dashboard and cannot be relisted. To delete your listing, click the Edit button under the listing name on the My Listings page to access the listing form; you should see a Delete button at the bottom of the listing form. Please note that this function cannot be undone.

  • For Chairish In-Home Delivery, Chairish Local Delivery, and Parcel shipping orders, buyers have 48 hours after delivery to inspect their item(s) and contact us if they wish to return an item. There are no restocking fees, but we deduct outbound and return shipping charges from the buyer's original purchase price (+ taxes if applicable). For Parcel Shipping returns, buyers will be responsible for packaging and shipping the return within three business days after return shipping label (pre-paid by Chairish) is received. Buyers may not be reimbursed for returns that are not received in original condition.

    For Local Pickup and Local Delivery orders, all sales are final once buyer takes possession of item. The 48-hour return policy does not apply. If you decide to cancel the order at pick up, you or your agent must reject the item at the time of pickup or delivery from the seller. Do not take the item with you or accept the curbside delivery.   • Please notify Chairish immediately if you believe that your purchase was damaged in transit. We will follow up as appropriate. For Chairish In-Home, Chairish Local Delivery, and Parcel shipping orders, buyers have 48 hours after delivery to inspect their item and contact [email protected] if there is a problem or they wish to return an item. Please include photos and a description of any damage that you believe occurred during the shipping process. All requests or concerns should be sent to [email protected]. Please do not contact the seller or shipper directly.

    Chairish In-Home and Chairish Local Delivery

    Items are insured by the In-Home Delivery service provider up to the value of the transaction amount for damage or loss (with repair or replacement of item as appropriate). Each item is inspected at both pick-up and delivery. This does not cover minor wear or minor condition discrepancies. This does cover any significant damage that clearly occurred during the shipping process.

    Parcel Delivery

    The seller is responsible for ensuring that each item is safely packed to prevent damage in transit. If a purchase is clearly damaged in transit we will initiate a claim with the appropriate carrier. The carrier will schedule a pickup of the damaged item and we will refund the buyer upon completion of the claims process.

    When Chairish is the shipper of record, on behalf of our sellers, Chairish does declare the sale price of all items shipped. This insures each package against loss. This also covers damage when it is determined that the item was properly packed. When damage has clearly occurred during shipping Chairish will file a claim with the appropriate carrier. Chairish will only reimburse the seller if the claim is accepted.

    When a seller chooses to "Arrange my own shipping" the seller is responsible for resolving any claims for loss or damage. We will notify the seller if loss or damage is reported and will provide the seller with the information and photos needed to initiate a claim.

  • Your Chairish shop is visible to all Chairish users and some aspects can be customized. From your Shop Settings page, you can change your profile image, banner image, display name, and shop bio. You can also create a custom URL for your shop! Keep in mind, though, that once you select a URL, youwon'tbe able to change it.

    To update your shop settings, including profile and banner images, please visit Shop Settings from your Account Settings page.

  • Listing is free and easy, and you can delist an item at any time. We pay Consignor sellers 70% of the revenue from each sale and 80% to Professional and Elite sellers after the item has sold. For more information on the Chairish commission, please read here.

    Before you begin listing, please review the Chairish Curatorial Guidelines for detailed information aboutwhat items we accept into our marketplace.

    For each listing, you'll be guided through a simple 3 step process in which youll be prompted to provide photos of your item, title and description, asking price, measurements, and quantity (if you have more than one of the same item). You can also talk about your item's materials, history, and more. The more information you can provide to the buyer, the more likely you are to have a successful sale without a return.

    The listing form will guide you through all necessary information and will highlight errors or incomplete fields that require your attention in real time as you complete the form. The form features a summary view to easily review how your listing page will look once your item is live. Youll see a progress bar at the top of the listing form that will illustrate the completeness of the form and will highlight any of the 3 sections that still need work.

  • Chairish customers have 48 hours after delivery to initiate the return of an item. Assuming the seller is not responsible for any damage or item inconsistencies from the listing, the buyer is responsible for all outbound and return delivery charges and will not be refunded until their purchase has been returned to the seller in good order.

    While we never like to see a sold item returned, this policy has been extremely helpful in building a trusted national marketplace for our sellers. The best way to ensure that sales are final is to be accurate, clear, and honest about the description and condition of your listings. Include clear, well-lit photos that capture all angles and any (even minor) flaws. Keep in mind,even with the best descriptions and photos, sometimes the item justisn'ta fit for the buyer.

    If a buyer contacts you - the seller - directly requesting a return, please contact Chairish Support for further instructions.

    If Chairish determines the listing was inaccurate,or if the buyer receives inaccurate information from the seller about the product,Chairish will charge the seller for both outbound and return delivery charges.

    If the seller has offered free shipping the expense incurred to ship the item will not be reimbursed to the seller.

  • All offers are "verified offers" which shows the seller that you are serious about purchasing their item:

    The minimum offer must be at least 50% of the listing price.

    Upon submitting an Offer, your credit card will be charged for the full offer amount, including shipping, taxes, and fees.

    The seller has 72 hours to accept, decline or counter the verified offer.

    If your offer is declined or the seller counters, we release your funds immediately. Typically, the pending offer charges will simply "disappear" from your bank or credit card statement and you will not see a discrete charge and credit.*

    If the item that you are interested in is available in multiples, simply change the quantity by hitting the + (or minus) sign until you have the desired number selected. Enter in the amount you are willing to pay, per item andChairish will calculate the total you will pay if your offer is accepted. Your Offer Summary will display the item(s) subtotal ( number x price per item) plus all shipping, taxes, and fees, for the total amount you will be charged.

  • All sales are considered final after the 48 hour return period has passed, or a local pickup or local delivery has been completed.

    Depending on your account set up, payment is issued via PayPal or direct deposit.Members of our Elite Seller Program will receive half of their payment when sold items are picked up, and the other half after the 48 hour return period has passed; Consignor and Professional sellers receivepayment within 6 days after delivery or local pickup/delivery is confirmed. In all cases, sellersalways receive an email confirming payment.

    You can also confirm that payment is being processed when an item shows as 'Delivered' in the 'My Sold Items' portion of the dashboard. When the order moves from to 'Payment Issued' the funds have been transmitted. You can use the link below to see your sold items!

    To ensure timely receipt of your funds, make sure payment information is kept up to date in your Payment Settings.

    To protect both buyers and sellers, Chairish collects payments from buyers at the time of sale and holds the proceeds until after confirmation that the item has been picked up or delivered safely to its new home.

  • The first step of the listing form will ask for you to create a Title for your listing and assign it a category based on the type of item you are selling. The form will also ask for you to upload photos that accurately represent your item for sale. You will upload photos at the beginning of the listing process so that they can be easily referenced as you complete the form. Please reference your photos to describe your item in writing in the Description field, as well as to select Brand/Designer/Artist, Style, Material, Color, and Room tags in Step 2: The Details section of the listing form.

    As you are filling out Step 1: The Basics, you will receive error messages as you go if you have left any required fields empty. Once you have completed The Basics, click the Next button to continue onto Step 2 of the listing form. If you would like to save your listing as a draft to finish later, click the Save button in the top right of the listing form page.

    Title of Your Listing

    Your listing title should be as descriptive as possible, as the keywords included in the title will help shoppers locate your item.

    Use the following formula to create a descriptive title for your item. If youdon'tknow the maker, date, or style, be as detailed as possible with the details you do know about your item.

    Date/Period + Style + Maker/Brand + Color + Material + Category

    Example: "1950s Mid-Century Eames Black Leather Lounge Chair"

    Please avoid adding any promotional messages in the title, such as: Sale, Free Shipping, BOGO, etc., as they do not contribute to your listing's search rank.

    Category

    Correctly categorizing your products will help shoppers locate your product quickly via advanced search filters and the navigation menu.

    When you click into the Category field, a list of all possible category options available will appear. You can drill down to subcategories to select the most relevant categorization for your type of item.

    You can also simply start typing the word for the type of furniture or decor item that best applies to your item for sale. As you start typing, a list of Category tag options will appear. Select the most appropriate Category tag from the list.

    Photos

    Great photography will draw a shopper into your listing when they are browsing or searching on Chairish. Great photos give our customers the confidence to make a purchase - even when theycan'tsee the product in person.

    You can upload up to 12 photos of your item and we encourage you to upload as many photos as possible.Width or height of each photo must be at least 460 pixels.

    You can drag and drop a group of images into the photo upload field in order to upload all images for your listing at once. Once all images are uploaded, you can also drag and drop each individual photo to reorder the sequence of the photos. The first photo on the listing form, which is also the largest photo block, will be the thumbnail image for your listing and will receive a silhouette edit on a white background.

    Description

    In the description, it is encouraged that you document all of the details of the product with a minimum of 2 full sentences. It is also helpful to format the description with correct grammar and punctuation so that the first impression of your item to the shopper is clear and professional.

    Although there is no strict format to follow when creating descriptions, it is important to know what should and shouldnt be included. All keywords in the description are searchable on our site and on search engines. Please add any key terms you think are important for locating your listing via search within the body of the description paragraph(s).
